This is a 14 page writing with 12 Tabs about the expenditures of Mr. Larry Cohn, Executive Director, Alaska Judicial Council (AJC), during and after the Retention Election 11/2/10. Judge Richard Postma was the only sitting Alaska judge that was not recommended for Retention by AJC on 6/28/10 so it was as if all the money that was spent during the Retention Election was to non-retain Judge Postma. Tab 1 is AJC "Current Judicial Vacancies" of which there are 7 openings currently. Tab 2 is "Judicial Selection 4/4-5/11" and Tab 3 is 6/28/11 "Summary of Major Issues." Tab 4 is the charging document of Alaska Commission on Judicial Conduct (ACJC) 12/6/10 that shows that Judge Postma was an excellent Anchorage District Court judge. Tab 5 is Judge Postma's acceptance of ACJC ruling against him 12/15/10. Tabs 6 & 7 are a total $11,086.00 that was spent on radio ads in which Vic Fischer spoke only against Judge Postma in the days before the Retention Election which broke 2 AAC 50.356(b), AS 15.13.040(h)(2), AS15.13.145 (c)(2) and other Alaska Statutes and Regulations. Also, a basic tenet of APOC Campaign Financial Disclosure is that a Retention Election that spends more the $250 a day in the nine days before the Election must file a 24 Hour Report. Mr. Cohn did not file any 24 Hour Reports but Tab 8 clearly shows he spent over $250 on 6 of the 9 days before the Retention Election. Mr. Cohn attempted to cover this up by telling APOC that he was not required to pay for the Retention advertising until after the ads ran which is a blatant falsehood. All Alaska Election advertising must be paid for in advance of being aired. I allege that Mr. Cohn committed criminal forgery when he submitted more Retention advertising bills Tab 9 on 1/26/11. AJC's total expenditures during Retention Election were $43,710.22. Tab 10 shows that the allocated amount for educational advertising during Retention Election 2010 by Alaska Legislature was $24,100.00 so Mr. Cohn overspent his Budget by $19,610.22. Upon researching past Retention Elections, it was uncovered that AJC overspent it allocated State of Alaska Budget during Retention Elections FY98, FY01, and FY05 as well as FY11.
