Alaska Bar Rules 43 and 44

Please also review HB 175 entitled “Civil Legal Service Fund” or funding for Alaska Legal Services Corporation. Per #4 of this section, a chart released by Ms. Deborah O’Regan, Executive Director, Alaska Bar Association on 2/17/06 gave information on Alaska Bar Rules 43 and 44. Regarding Bar Rule 43, half or 10 out of 20 of the attorneys practicing at Alaska Legal Services Corporation are licensed under this rule which allows attorneys who are licensed in reciprocal states to practice at Alaska Legal Services Corporation without taking Alaska Bar Exam and without paying Alaska Bar dues which are $550 or some of the highest if not the highest of the fifty states. Please review Todd Communication Alaska Directory of Attorneys Spring 2006 Page 31 for more information about Alaska Legal Services Corporation. HB175 did not pass Alaska Legislature in Spring, 2006. The same chart lists per Alaska Bar Rule 44.1 “Foreign Law Consultants” Nickolai Shcherbina, a foreign Russian, who since 9/23/93 has had more access to Alaska Court System than all the Alaskan/American law license applicants who have “flunked” Alaska Bar Exam which usually has a passage rate every six months of about 60% or less. Based on the chart, it does not look as though Alaska Bar Association cares about “Legal Interns” and “Military Attorneys.” Both are very large groups in Alaska, and yet, on the chart there are only four names listed.
